A partir de la publicación del Decreto Legislativo No. 1421 (DL 1421), hace poco más de 2 años, se ha puesto en debate la regulación de la prescripción tributaria. En específico, se debate la constitucionalidad de la disposición que pretende regular la aplicación en el tiempo los plazos de la prescripción. Pues tratar de incluir en la prescripción tributaria lo dispuesto en el citado Decreto Legislativo conlleva una contravención al Principio Constitucional de Irretroactividad de Normas previsto en el artículo 103 de la Constitución.
A todas luces, lo que pretende la disposición del DL 1421 es extender la aplicación de una “nueva” regla sobre el inicio del cómputo del plazo prescriptorio, vinculado a la facultad de la Sunat para exigir el pago de deudas tributarias (el plazo fue normado en el año 2012, pero precisando otro inicio del cómputo). Es decir, pretende que la nueva regla se aplique a plazos prescriptorios que iniciaron su computo con anterioridad a la inclusión de dicha regla (entre el 2012 y 2018).
No olvidemos que, el fundamento constitucional de la prescripción tributaria es el derecho a la Seguridad Jurídica de todos los peruanos, posición que ha sido reconocida en diversa jurisprudencia del Tribunal Fiscal.
En ese sentido, es inconcebible sostener la constitucionalidad de la norma, haciendo una “valoración” entre los principios de seguridad jurídica y el deber de contribuir, argumentando que debe primar este último en aras de privilegiar la justicia tributaria con la finalidad de lograr una mayor recaudación de impuestos. Más aún mencionar la cifra en controversia no puede servir como argumento tributario ni jurídico, porque lo que está en juego es la vulneración de los derechos de todos los contribuyentes.
Como punto adicional, el DL 1421 decretado por el Ejecutivo excedió los parámetros establecidos por la norma donde el Congreso de la República le delegaba funciones legislativas (Ley No. 30823), sobrepasando los límites materiales otorgados e infringiendo lo establecido en el artículo 104 de la Constitución.
